The National Student Financial Aid Scheme (NSFAS) has urged landlords to not require a deposit or top-up payment from NSFAS-funded students.

This arrives immediately after NSFAS acquired stories about some accommodation suppliers who need NSFAS-funded students to pay a deposit or top-up payment in order to get access to the authorised private accommodation.

"NSFAS reminds accommodation companies of your obligatory conditions, as furnished by the Standardised Fixed-Term Lease Settlement between the non-public accommodation suppliers and NSFAS funded students," NSFAS stated in a statement on Thursday.

The Standardised Fixed-Term Lease Agreement states which the rent might be paid regular for the accommodation provider (lessor) by NSFAS, on behalf with the lessee (NSFAS funded student), in accordance with the NSFAS conditions and terms for private accommodation vendors’ participation on the student accommodation portal.

"The lessor may not demand or allow the lessee to pay a deposit, top-up payments, or another types of payment into the lessor, or some other person in reference to this arrangement, like payment of hire, whilst awaiting payment from NSFAS. The lessor shall don't have any recourse versus the lessee for any default during the payment of rent by NSFAS," the arrangement reads.

The NSFAS terms and conditions for private accommodation suppliers’ participation on the student accommodation portal also states that: "Where the NSFAS-funded here student is defunded due to an incorrect decision by NSFAS, the student won't be accountable for payment of any arrear rent towards the accommodation service provider, up until finally the day of being defunded."

NSFAS explained that in which the NSFAS-funded student chooses to continue occupying the leased premises, notwithstanding being defunded by NSFAS, the scholar will be chargeable for payment of rent on the lessor in the day of currently being defunded.

"Where the student is defunded by NSFAS due to a misrepresentation by the lessee/guardian at any stage, the student nsfas status check must immediately vacate the leased property; and will be liable for payment nsfas application delay of all rent due to the accommodation provider.

The scheme emphasised that any dispute arising between the parties regarding the interpretation or implementation of the agreement, must be dealt with in accordance with any dispute resolution procedure determined by NSFAS for this purpose.
